By accessing or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
2. Description of Service
Schedulala is a web-based platform that enables users to schedule and manage social media posts across multiple platforms including but not limited to:
- Twitter/X
- Facebook Pages
- Instagram Business Accounts
- Bluesky
- YouTube Shorts
The Service allows users to create, schedule, and automatically post content to connected social media accounts.
3. User Account and Responsibilities
3.1 Account Creation
To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials.
3.2 Age Requirements
You must be at least 13 years old to use the Service. If you are between 13 and 18 years old, you must have parental consent to use the Service.
3.3 Platform Account Ownership
You must own or have explicit authorization to manage all social media accounts you connect to our Service. You are solely responsible for all content posted through your connected accounts.
4. Platform Integration and Third-Party Services
4.1 OAuth Authorization
Our Service uses OAuth and official APIs to connect to social media platforms. By connecting your accounts, you authorize us to post content on your behalf according to your scheduling instructions.
4.2 Platform Compliance
You acknowledge and agree that your use of connected social media platforms is subject to their respective terms of service, community guidelines, and policies. We are not responsible for changes to third-party platform policies that may affect our Service.
4.3 Platform Limitations
Some features may be limited by third-party platform restrictions. We reserve the right to modify or discontinue features based on platform policy changes or API limitations.
5. Content and Usage Guidelines
5.1 Content Responsibility
You are solely responsible for all content you create, schedule, or post through our Service. You warrant that you have all necessary rights to use and distribute your content.
5.2 Prohibited Content
You may not use the Service to post content that:
- Violates any applicable laws or regulations
- Infringes upon intellectual property rights
- Contains hate speech, harassment, or discriminatory content
- Promotes violence or illegal activities
- Contains spam, malware, or deceptive practices
- Violates the terms of service of connected platforms
5.3 Automated Posting Disclosure
You acknowledge that posts made through our Service are automated and scheduled. You are responsible for ensuring that your automated posting complies with the community guidelines and terms of service of each platform.
6. Subscription and Payment Terms
6.1 Subscription Plans
Our Service offers multiple subscription tiers with varying features and limitations. Current plans include Individual Creator, Multi-Brand Creator, Agency Pro, and Enterprise Campaign tiers.
6.2 Billing and Payments
Subscription fees are charged monthly in advance. All payments are processed through Stripe. You authorize us to charge your selected payment method for recurring subscription fees.
6.3 Free Trial
We offer a 7-day free trial for new users. If you do not cancel before the trial period ends, you will be charged for your selected subscription plan.
6.4 Refunds and Cancellation
You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. We generally do not provide refunds for partial billing periods, except as required by law.
7. Data and Privacy
Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our data collection and usage practices as described in the Privacy Policy.
8. Intellectual Property Rights
8.1 Our Intellectual Property
The Service, including its software, design, and content, is owned by us and protected by copyright, trademark, and other intellectual property laws.
8.2 Your Content
You retain ownership of content you create and post through our Service. By using the Service, you grant us a limited license to process, store, and transmit your content solely for the purpose of providing the Service.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.
We are not responsible for:
- Content posted by users through the Service
- Actions taken by third-party social media platforms
- Technical issues or downtime of connected platforms
- Changes to third-party platform APIs or policies
- Account suspensions or bans on connected platforms
10. Indemnification
You agree to indemnify, defend, and hold harmless Schedulala and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.
11. Service Availability and Modifications
11.1 Service Availability
We strive to maintain high service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or technical issues.
11.2 Modifications to Service
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.
12. Termination
We may terminate or suspend your access to the Service immediately, without prior notice, if you violate these Terms. Upon termination, your right to use the Service ceases immediately.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of Canada. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration authority.
14. Changes to Terms
We may update these Terms from time to time to reflect changes in our Service or legal requirements. We will notify users of material changes via email or through the Service. Your continued use of the Service after changes constitute acceptance of the new Terms.
